Welcome to KulykKul! These Terms and Conditions (“Terms”) govern your access to and use of the KulykKul website (kulykkul.com), our mobile game development services, and any related products or content provided by KulykKul (“we”, “our”, “us”).
By accessing or using our website or services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use our website or services.
1. Services Provided
KulykKul is a mobile game development studio offering a range of services including, but not limited to:
- Custom Mobile Game Design and Development
- Mobile Game Art and Animation (2D and 3D)
- UI/UX Design for Games
- Game Porting and Optimization
- Post-Launch Support and Updates

2. Client Obligations
When engaging with KulykKul for services, you agree to:
- Provide accurate, complete, and timely information and materials as reasonably required for the project.
- Communicate clearly and promptly regarding project feedback, approvals, and decisions.
- Make timely payments for services rendered as per the agreed-upon payment schedule and contract.
- Ensure that any content or intellectual property you provide to us for use in the project does not infringe upon the rights of any third party.
3. Intellectual Property Rights
a) KulykKul’s IP: All content on the KulykKul website, including text, graphics, logos, images, software, and the compilation thereof, is the property of KulykKul or its suppliers and protected by copyright and other intellectual property laws.
b) Client Project IP:
- Ownership: Unless otherwise explicitly stated in a separate service agreement or contract, upon full and final payment for a completed project, KulykKul will transfer to the client all intellectual property rights related to the custom game or specific deliverables created specifically for that client under the agreement.
- KulykKul’s Tools & Know-how: KulykKul retains all intellectual property rights to its underlying tools, methodologies, pre-existing code libraries, general know-how, and internal development processes used in the creation of the project. These are not transferred to the client.
- Portfolio Rights: KulykKul reserves the right to display and showcase the completed client projects in its portfolio, marketing materials, and website for promotional purposes, unless a specific non-disclosure agreement (NDA) or contract prohibits such display.
4. Payment Terms
- Specific pricing for our services will be outlined in a separate proposal, service agreement, or contract.
- Payment schedules, deposit requirements, and payment methods will be detailed in the project agreement.
- All payments are due as per the agreed-upon schedule. Delays in payment may result in project suspension or termination, as outlined in the specific project contract.
- All prices listed on our “Services” page are estimates and subject to change. Final prices are provided via a personalized quote.
5. Confidentiality
Both KulykKul and the client agree to keep confidential all non-public information received from the other party during the course of their engagement, including but not limited to project details, business strategies, and proprietary technology, unless otherwise agreed upon or required by law. This obligation typically survives the termination of the engagement for a specified period.
6. Disclaimers and Limitation of Liability
a) Website “As Is”: The KulykKul website and its content are provided “as is” and “as available” without any warranties of any kind, either express or implied, including but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
b) Service Guarantees: While we strive to deliver high-quality services, KulykKul does not guarantee that our services will be error-free or uninterrupted. We will endeavor to correct any errors or defects brought to our attention in a timely manner as per the project agreement.
c) Limitation of Liability: To the fullest extent permitted by applicable law, KulykKul shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the website or services; (ii) any conduct or content of any third party on the website;(iii) any content obtained from the website; and (iv) unauthorized access, use, or alteration of your transmissions or content.
7. Termination
KulykKul reserves the right to terminate or suspend your access to our website or services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.
8. Governing Law and Dispute Resolution
These Terms shall be governed and construed in accordance with the laws of Ukraine, without regard to its conflict of law provisions.
Any dispute, controversy, or claim arising out of or relating to these Terms or the breach, termination, or invalidity thereof, shall be settled by the courts of Ukraine.
9. Changes to These Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our website or services after those revisions become effective, you agree to be bound by the revised terms.
