At KulykKul, we are committed to delivering high-quality mobile game development services and ensuring client satisfaction. Due to the nature of custom software development, our refund policy is designed to address the specific characteristics of project-based work.
1. General Policy
Our services involve significant intellectual effort, time, and resources invested from the initial consultation and planning stages. Therefore, all payments made to KulykKul for custom mobile game design and development services are generally non-refundable. This policy applies to deposits, milestone payments, and full payments for completed work.
2. Exceptions and Specific Cases
While payments are generally non-refundable, we may consider partial refunds or alternative resolutions under the following specific circumstances, always at our sole discretion:
- Project Cancellation by KulykKul: In the unlikely event that KulykKul initiates the cancellation of a project before its completion, and it is not due to a client’s breach of contract (e.g., non-payment, failure to provide necessary assets), we will assess the work completed up to the point of cancellation. A partial refund may be issued for services that were paid for but not yet rendered, minus any costs incurred by KulykKul for planning, design, and initial development efforts.
- Failure to Deliver: If KulykKul fails to deliver the agreed-upon project milestones or the final product as specified in the signed service agreement, and this failure is solely attributable to our negligence or inability to perform, we will first attempt to rectify the issue. If rectification is not possible or acceptable to the client, a proportional refund for the undelivered portion of the service may be considered.
- Errors or Defects in Delivered Work: For errors or defects in the delivered work that are directly attributable to KulykKul and significantly impact the functionality or quality of the product as defined in the project scope, we are committed to fixing these issues free of charge. Refunds will not be issued for such issues, as our primary commitment is to deliver a fully functional and compliant product.
3. Non-Refundable Situations
Refunds will generally not be issued in the following situations:
- Change of Mind: If the client decides to cancel the project or no longer requires the services after development has commenced.
- Client Delays or Non-Cooperation: If project delays or failures to meet deadlines are due to the client’s failure to provide timely feedback, necessary assets, or adhere to agreed-upon communication schedules.
- Breach of Contract by Client: If the client breaches any terms of the service agreement, including but not limited to non-payment of invoices.
- Third-Party Issues: Problems arising from third-party services, platforms, or assets not directly controlled or provided by KulykKul.
- Changes to Project Scope: If the client requests significant changes to the project scope after development has begun, which leads to additional costs or delays. Such changes will typically require a new agreement or amendment to the existing one.
- Dissatisfaction without Material Breach: While we strive for satisfaction, refunds are not provided based on subjective preferences or minor aesthetic discrepancies that do not constitute a material breach of the agreed-upon specifications.
4. How to Request a Review for a Refund
If you believe your situation warrants a review for a potential refund based on the exceptions outlined above, please submit a written request to [email protected]. Your request must include:

- The project name and relevant dates.
- A detailed explanation of the reason for your refund request.
- Any supporting documentation or evidence.
All refund requests will be reviewed on a case-by-case basis. We aim to respond to all inquiries within 10 business days.
